All other information remains the same. **************************************************************************** 4. INVITATION TO TENDER The Contractor shall submit the tender in a lump sum. Such lump sum shall be deemed to include all such sums as the contractor considers proper for expenses and profit in connection with the work involved and shall be in full compensation for the completed work. b. The sum named in the tender form is subject to acceptance by Butternut Valley for a period of forty-five days (45) days beginning at the tender closing date. If the tender is not accepted within their period, the Contractor may request the tender be withdrawn. c. Tenders will be called and awarded in accordance with the Butternut Valley Purchase and Sale Policy. d. The Contractor shall be deemed to have inspected the territory and have been satisfied as to the nature of the work and, in general, to have obtained all necessary information on all conditions affecting their tender. e. Prior to the award of the contract, each Contractor must provide the contact information for two (2) references for whom the Contractor has completed work of a similar nature to that contemplated by their call for tenders within the past five (5) years. f. In addition to the references provided by the Contractor, Butternut Valley may consult with other owners and other departments and agencies of the Province of New Brunswick to obtain information on the Contractor's past performance within the previous two (2) years. g. Butternut Valley Rural Community reserves the right to add or remove additional locations throughout the term of the contract. h. Butternut Valley Rural Community reserves the right to terminate their contract upon providing thirty (30) days' written notice to the successful Contractor(s) if Butternut Valley changes the manner in which the services contemplated by their tender are delivered. In such event, the Contractor(s) shall not be entitled to any compensation, damages, penalties, or other costs arising from or related to the termination of the contract. i. The lowest bid is not necessarily accepted.
